Preliminary Draft of New Labor Code Presented for Debate

Authorities from the Ministry of Labor and Social Security (MTSS) presented a preliminary draft of the Labor Code. Which workers must study and debate starting in September. The proposed changes constitute a new law rather than an update to the current law, reported the newspaper Trabajadores.

This was confirmed by Olgalidi Alapón Travieso, an expert from the Legal and International Relations Department of the MTSS. Who confirmed that the document will be submitted for consultation from September to November.

The Code will update the regulations that guarantee the protection of rights and the fulfillment of duties. Will apply to all workers, regardless of the sector in which they work.
The future legal provision will establish judicial, institutional, and union mechanisms. To enforce these rights and duties, while also developing aspects related to collective labor relations.

The draft is the result of contributions from a group composed of representatives of agencies, organizations, labor law specialists, university professors, organizations, employers, and union leaders. Who studied the comparative legislation of 17 countries and the 90 international conventions ratified by Cuba.

Among the new features are the change from 17 to 18 years of age as the age for establishing employment relationships. Also the use of fixed-term contracts for permanent jobs.
Another proposal is to change the principle of demonstrated suitability to that of demonstrated ability for employment. Establishing guidelines to guarantee access for people with disabilities.

“Regarding wages, the Labor Code defines the elements that comprise remuneration, minimum wage protection, and the principles that wage systems must follow,” concluded Alapón Travieso.
